On the 13 December 2011 the meeting of the Austrian Economic Forum took place in the famous Moscow restaurant Petrowitsh. Specht Rechtsanwalt GmbH hosted this event where numerous representatives of Austrian corporations got together.

Treaties between Austria and Serbia on economic cooperation

Relations between the two countries started to intensify in particular after the democratic changes in Serbia of 2000, so up to present cooperation has developed at the political level, as well as in the realms of economy, culture and education. Austria is at the first place among the countries from which investments in Serbian economy have come since 2000 onwards – Austrian companies and banks have invested over USD 2.6 billion. There is a large number of representative offices and subsidiaries of Austrian companies in Serbia - around 280 in total. On the other hand, a great number of Serbs live and work nowadays in Austria; it is estimated that there are about 180,000 Serbs only in Vienna, while about 5-6 thousand companies are owned by Serbs. All the above mentioned shows the close connection between Serbia and Austria, and institutional frameworks for cooperation have been established by pertinent bilateral treaties.

Foreign investments – legal framework in Serbia

Since it experienced democratic changes in 2000, Serbia has invested great efforts in order to attract foreign investments. The accession of Serbia to European Union is expected to happen with great certainty (official status of member candidate is expected soon), monetary and banking systems are stable, and legislation has been to a great extent adjusted to fostering market economy and foreign trade. Besides, the Government of Serbia in 2010 enacted a Decree on terms and manner of attracting direct investments, which foresees special measures and incentives.

Position of a merchant in Serbia according to the new Consumer Protection Act

The Law on Protection of Consumers (effective as of 1 January 2011) has raised the level of consumer protection in Serbia. One of the main goals of the new law is to eliminate unfair and unconscientious business behavior by defining more precisely the codes of conduct and obligations of merchants. At the same time, the new law completely complies with the European Union law, having in mind implementation of the fifteen key EU Directives on consumer protection.

The Custom Union between Russia, Belarus and Kazakhstan

The custom union based on the 6. October 2007 Custom Union Agreement among Russia, Belarus and Kazakhstan, is the most successful attempt at economic integration of any of the countries in the post-Soviet territory. On 10. January 2010, the Custom Union member-states implemented the Unified Custom Tariff for goods imported to the common custom territory from third party countries.

Draft Law for the Protection of Users of Financial Services in Serbia – effects, objectives and remarks

By virtue of the new Law for the protection of users of financial services, which is in the procedure of adoption before the Parliament of Serbia, the EU Directive on granting loans to consumers shall be applied, which will afford users of financial services in Serbia the protection in accordance with standards and level of protection in the European Union.

Changes in the Austrian Law on Mortgages and Loans

Recent changes in the Austrian law on mortgages and loans have changed and modernized parts of the Austrian Civil Code and introduced an Austrian Consumer Credit law. The newly introduced regulations draw a distinction between mortgages and loans which fall under the Austrian Civil Code and those that are regulated according to the new Consumer Credit Law. With the exception of a few transition provisions, the new regulations enter into force as of 11. June 2010.

Dr. Specht participates in “New Challenges and the Concept of International Law“ – one of the preparatory meetings of the Global Policy Forum 2010, Yaroslavl, Russia

On 07 May 2010, the preparatory committee for the Global Policy Forum, an initiative of President Dimitriy A. Medvedev, and the Institute for Global Law and Policy at Harvard Law School, organized a workshop at Harvard Law School. The workshop aimed at shaping some of the questions of the four sections of this year’s Global Policy Forum – “New Challenges and the Concept of International Law”. This year’s Global Policy Forum will take place on 09 September 2010.

Specht Rechtsanwalt GmbH hosts International Working Group on Russian Civil Code

The Civil Code of the Russian Federation is subject to review. To this effect, working groups have been formed with the Research Center for Private Law with the Administration of the President of the Russian Federation. As a first step, a so-called conceptia was approved containing the basic principles of the reform. Now the Civil Code is undergoing redrafting in accordance with such conceptia. A preliminary draft of a first part of the Civil Code has been prepared and concerns the new regulation of legal entities. As in the past, Professor Dr. Peter Doralt and Dr. Leopold Specht are organizing the workshop-like meetings between Russian experts involved in the drafting of the Civil Code and Austrian experts in the relevant fields.

ALPINE Bau GmbH and RZDstroy found infrastructure joint venture

On January 29th, in the presence of Mr. Vladimir Yakunin, president of the Russian Railway, and Mr. DI Dietmar Aluta-Oltyan, ALPINE Bau GmbH and RZDstroy founded a joint venture called "Alpine-RZDstroy GmbH”, which was incorporated under Austrian law and operates in Vienna. After the foundation of the company in Vienna, a representative office in Moscow will be established. The goal of the corporation is the acquisition, tender preparation and the subsequent carrying out of project-specific infrastructure projects in the area of the Russian Federation, in Austria, and third countries.
